PRIVACY POLICY

Application of Policy

Leap In recognizes the importance of privacy and the sensitivity of Personal Information (defined below) and believes in protecting your privacy. This policy outlines how Leap In manages your Personal Information and safeguards your privacy.

This policy does not apply to the practices of companies or other entities that Leap In does not manage or control. This policy does not apply to information regarding corporations or other non-individuals.

Definitions

The following definitions are used for the purposes of this policy:

“Personal Information” means information about an identifiable individual, and includes things such as name, gender, age, ethnicity, financial and credit information, health information, consumer preference information, customer profiles, ID numbers, date of birth, demographic information and any other data assigned to an individual.

“Summarized Data” mean records which have been stripped of information potentially identifying individuals, and which have been manipulated or combined to provide generalized, anonymous information.

Collection of Personal Information

This policy covers Leap In's treatment of Personal Information that Leap In collects in connection with the Web site “Just Leap In” (the “Site”). Leap In collects Personal Information from you when you use the Site, and may from time to time collect additional Personal Information in the course of providing you customer service and the services of the Site. Leap In may track, record, and observe your actions within the Site and track Site usage information, including Site features, forums and downloads. If you install or use Leap In software, Leap In may collect information to verify your unique identity and to monitor system performance.

The Site allows you to publish Personal Information about yourself and others, including videos and photos. By publishing your Personal Information on such pages, you consent to the publication of such Personal Information. By publishing Personal Information about another individual, you represent that you have, where required by applicable privacy laws, obtained the consent of such individuals to publish such information.

Leap In may use customer information for additional purposes that may be identified at or before the time that the information is collected.

Use of Personal Information

Leap In may use your Personal Information for the following purposes:

  • to administer and build your Leap In account;
  • to market new services that Leap In believes will be of interest to you;
  • to enhance and tailor each visitor's experience at the Site, showing the user content in which Leap In thinks you might be interested, and displaying the content and providing you with an experience according to your preferences;
  • as required or authorized by law; and
  • to provide use and services of the Site to you.

Disclosure of Personal Information

Leap In does not and will not sell, rent, share or disclose your Personal Information without first receiving your permission or as disclosed in this policy.

Under certain circumstances, Leap In will disclose your Personal Information:

  • when you have consented to the disclosure;
  • to fulfill the purpose for which the Personal Information was collected;
  • when the services Leap In is providing to you requires Leap In to give information to third parties;
  • where it is necessary to establish or collect fees;
  • if Leap In engages a third party to provide services to it (like computer hosting, back-up services or archival file storage);
  • if the information is already publicly known;
  • when Leap In is required or authorized by law to do so;
  • to legal, financial, insurance, and other advisors or in connection with the sale, reorganization, or management of all or part of Leap In's business or operations;
  • to an acquirer of Leap In's business, or someone with whom Leap In merges or combines its business; and
  • as purposes that are identified when the Personal Information is collected.

Summarized Data

Leap In may also use your Personal Information to generate Summarized Data for internal use and for sharing with affiliates, subsidiaries, advertisers and business partners. Your identity and Personal Information will be kept anonymous in Summarized Data.  Summarized Data will be used for marketing and planning purposes.

Site

Please remember that you control what Personal Information you provide while visiting the Leap In Site. You can visit the Leap In Site without registering or providing any Personal Information at all.

You may choose to disclose Personal Information in interactive areas, discussion forums or bulletin boards on the Site. However, Leap In cannot and does not control the actions of other users of the Site with whom you share your Personal Information, or guarantee that your Personal Information will not be seen by persons you did not authorize to see it, and therefore you should not expect privacy or confidentiality of any information you disclose on the Site. Leap In is not responsible for circumvention by anyone of any privacy settings or security measures for the Site. You may remove Personal Information that you post on the Site, but you acknowledge that Company may retain archived copies of your Personal Information.

The Site contains links to other websites, which are not governed by this policy. You should read the individual privacy policies of such websites, and make an informed decision whether or not to use these sites based upon their privacy practices.

Like most other commercial websites, the Site may monitor traffic patterns, site usage and related site information. Leap In may automatically (i.e., not via registration) collect or compile certain information that is not personally identifiable when you access the Site. Examples of this type of information include the aggregate and unique number of visitors to the Site, the dates and times of visits to the Site, the domains/countries of visitors, the pages of the Site visited and the content accessed, the browsers, operating systems, search engines and search terms used to visit the Site and HTTP errors generated. Leap In uses this information in order to optimize the Site and to assess usage of the Site. Leap In may provide such information to the Site contractors for these purposes, but this information does not include any personally identifiable information.

Cookies and IP Addresses

Leap In uses your IP address to help identify you and your subscription, gather broad demographic information about Leap In's users, diagnose problems with Leap In's systems, and administer the Site. The Site is entitled to use cookies to deliver content specific to your interests, according to your preferences, to simplify and enhance your experience on the Site, and to save your password so that you are not required to re-enter it while you use the Site.

Consent

By providing Personal Information to Leap In and by accessing, using or browsing the Site, you voluntarily consent to the collection, use and disclosure of Personal Information as specified in this policy. Without limiting the foregoing, Leap In may on occasion ask you to consent when Leap In collects, uses, or discloses your Personal Information in specific circumstances, in which case Leap In may record your consent in writing (including electronic writing). Sometimes your consent will be implied through your conduct if the purpose of the collection, use or disclosure is obvious and you voluntarily provide the information. In addition, Leap In may collect, use and disclose Personal Information without your consent when Leap In is required or authorized by law to do so.

Opting Out

You may wish to opt out of receiving certain communications, information and marketing or promotional materials from Leap In.  You may do so by contacting Leap In's privacy officer (the “Privacy Officer”) by email or phone using the contact information provided below.

Is my Personal Information Secure?

Leap In takes reasonable steps to ensure that your Personal Information is kept safe from loss, unauthorized access, modification or disclosure. Among the steps Leap In takes in order to protect your information are:

  • premises security;
  • restricted file access to Personal Information;
  • deploying technological safeguards like security software and firewalls to prevent hacking or unauthorized computer access; and
  • internal password and security policies.

However, it is possible that any information transmitted via the Internet may be intercepted by unknown third parties.

Children

Leap In does not knowingly collect Personal Information from persons under 13 years of age, and no one under 13 may use the Site or may provide Leap In with any Personal Information.

Opt-Out

When appropriate, users of the Site are given the opportunity to (a) opt-out of receiving communications from Leap In, (b) remove their Personal Information from Leap In's records, or (c) elect to no longer receive services from Leap In. If you wish to opt-out of receiving further communications, please contact Leap In's Privacy Officer by email or phone using the contact information provided below.

Corrections/Contact

You may contact Leap In's Privacy Officer to modify or correct any of your Personal Information that is under Leap In's control. You may also direct a written complaint regarding compliance with this policy to the Privacy Officer and, within a reasonable time upon receiving the written complaint, the Privacy Officer will conduct an investigation into the matter. Within a reasonable time of concluding the investigation, the Privacy Officer will inform you whether the complaint will be allowed or denied. If the Privacy Officer allows the complaint, Leap In will take appropriate measure necessary to rectify the source of the complaint.

Changes to this Privacy Policy

Since Leap In regularly reviews all of its policies and procedures, Leap In may change this policy from time to time by giving reasonable notice of the revised terms (including by posting on the Site) and such changes will be effective from the date of revision.

Miscellaneous

This policy will be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, excluding any conflict of laws rules that would apply a different body of law. This policy constitutes and contains the entire agreement between you and Leap In with respect to its subject matter and supersedes any prior oral or written agreements.

If any provision of this policy is held to be illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this policy will otherwise remain in full force and effect and enforceable.

Your Responsibility for Privacy

Ultimately, you are responsible for maintaining the secrecy of your passwords and/or any Personal Information in your possession. Always be careful and responsible regarding your Personal Information.
